2. Scope

These terms govern the purchase of FLÖDEN products through the online store.

The store is intended for consumers over the age of 18 who purchase products for personal use and not for resale.

The store is hosted on Shopify, which provides the technological infrastructure required to manage browsing, checkout and orders. The processing of personal data in connection with Shopify is explained in our Privacy Policy.

We currently deliver to mainland Spain, the Balearic Islands and the European Union countries enabled during checkout.

We do not deliver to the Canary Islands, Ceuta, Melilla or countries outside the European Union.

3. Product information

FLÖDEN endeavours to describe each product as accurately as possible, including its main characteristics, composition, colours, sizes, care instructions and price.

The photographs are intended to represent the products faithfully. However, there may be slight differences in colour due to the screen used or natural variations in the fabrics and manufacturing process.

Before placing an order, we recommend consulting the product description and the size guide available on the website.

4. Availability

All products are subject to availability.

The inclusion of a product on the website does not guarantee that it will remain available until the order has been completed. If, after a purchase has been made, we identify a stock error or are unable to supply the product, we will inform the customer and refund all amounts paid.

5. Prices and taxes

All prices are displayed in euros and include the applicable VAT.

The final product price will be the price displayed on the website when the order is placed. Delivery charges will be shown separately before payment is completed.

FLÖDEN may change its prices at any time, but such changes will not affect orders that have already been confirmed.

FLÖDEN does not regularly offer discounts. When a price reduction is announced, the previous price shown will be the lowest price applied during the preceding 30 days, where required by law.

6. Purchasing process

To make a purchase, the customer must:

  1. Select the product, colour and size.
  2. Add it to the cart.
  3. Review the selected products.
  4. Enter or confirm their contact, billing and delivery details.
  5. Select an available delivery and payment method.
  6. Review the total price, including taxes and delivery charges.
  7. Confirm the order using the button that clearly indicates that the purchase entails an obligation to pay.

Before confirming the order, the customer will be able to review and correct the information entered.

Purchases may be made as a guest or through a customer account, where this option is available.

The contract may be concluded in Spanish or English. The customer may save or print these terms before making a purchase.

7. Order confirmation

Once the purchase has been completed, we will send a confirmation to the email address provided by the customer. This confirmation will include the order number and a summary of the purchase.

The sales contract will be concluded when the order confirmation is sent.

The electronic record of the purchase will be stored by FLÖDEN and may be accessed through the customer account, where this feature is available, or requested by writing to info@flodenbrand.com.

If the customer does not receive the confirmation, they should check their spam folder or contact us.

8. Payment methods

The available payment methods will be displayed during checkout and may vary depending on the country, device or configuration used.

Payments are processed securely through Shopify Payments and the other enabled providers. The payment methods currently accepted are listed on our Payment Methods page.

The total amount will be charged when the order is completed, including for products purchased on pre-order.

FLÖDEN and its payment providers may carry out security and fraud-prevention checks. If payment cannot be authorised, the order will not be completed.

9. Order cancellation

The customer may request the cancellation of an order by writing to info@flodenbrand.com.

If the order has not yet been dispatched, we will cancel it and refund all amounts paid using the same payment method.

If the order has already been dispatched, it cannot be cancelled, but the customer may request a return in accordance with our Returns Policy.

10. Pre-orders

Products identified as pre-order items may be purchased before they are available for dispatch.

An estimated dispatch period will be stated on each pre-order product page. The full amount will be charged when the order is placed.

The customer may cancel a pre-order before it is dispatched and receive a full refund.

If a delay prevents us from meeting the stated period, we will inform the customer and offer the option to:

  • Keep the order and accept the new estimated dispatch period.
  • Cancel the order and receive a full refund.

If an order contains both available and pre-order products, the website will indicate before payment whether they will be delivered together or separately.

11. Shipping and delivery

The delivery charges and estimated delivery times are:

  • Mainland Spain and the Balearic Islands: €5. Estimated delivery within 3–4 working days from order confirmation.
  • European Union: €15. Estimated delivery within 5–6 working days from order confirmation.

Orders are normally prepared and dispatched on the next working day after confirmation. Orders placed during weekends or public holidays will be processed on the next working day.

Delivery times are estimates and may be affected by periods of high demand or circumstances beyond FLÖDEN’s reasonable control.

Full details are available in our Shipping Policy.

The customer must provide a complete and accurate delivery address. If an error is identified, the customer should contact us as soon as possible at info@flodenbrand.com.

The risk of loss of or damage to the products will pass to the customer when they, or a person authorised by them other than the carrier, take physical possession of the order.

12. Unsuccessful deliveries

If the carrier is unable to complete the delivery, it may make further delivery attempts or leave the order at a collection point, depending on the conditions of the service used.

The customer must follow the carrier’s instructions and collect the order within the stated period.

If an order is returned to FLÖDEN due to an incorrect address, repeated absence, failure to collect it or another cause attributable to the customer, we will contact the customer to agree on a solution. In such cases, the customer may be responsible for the cost of a new delivery.

If delivery cannot be completed for a reason attributable to FLÖDEN or the carrier, the customer will not be charged for the new delivery.

13. Statutory right of withdrawal

Consumers residing in the European Union have a statutory period of 14 calendar days from receipt of the order to withdraw from the contract without having to provide a reason.

To exercise this right, the customer must communicate their decision through a clear statement sent to info@flodenbrand.com. They may also use the Withdrawal Form, although its use is optional.

Once the withdrawal has been communicated, the products must be sent back without undue delay and, in any event, within the following 14 calendar days.

The customer will bear the direct cost of returning the products unless the product is incorrect, damaged or defective, or unless otherwise provided by applicable law.

When withdrawing from an entire order, we will refund all payments received, including the cost of the least expensive standard delivery method offered. Any additional costs resulting from the customer’s choice of a more expensive delivery method will not be refunded.

The refund will be made using the same payment method used for the purchase, unless expressly agreed otherwise, and will not incur any fees for the customer.

FLÖDEN may withhold the refund until it has received the products or until the customer provides evidence that they have sent them back, whichever occurs first.

14. 30-day commercial returns policy

In addition to the statutory right of withdrawal, FLÖDEN offers a commercial returns policy allowing customers to request a return within 30 calendar days of receiving the order.

When a return is requested after the statutory 14-day withdrawal period has expired, the commercial terms set out in our Returns Policy will apply.

For a return to be accepted:

  • The garment may have been reasonably tried on, but must not have been used beyond what is necessary to establish its nature, characteristics and size.
  • It must be returned unwashed and unaltered, without stains, odours or damage, and with its original labels and accessories.
  • We recommend using the original packaging, although its absence will not automatically result in the return being rejected.

For commercial returns requested after the first 14 days, the original delivery charges will not be refunded unless otherwise required by applicable law.

The original delivery charges will also not be refunded in the case of partial returns.

15. Exchanges

We do not offer direct exchanges for a different size, colour or product.

To purchase another size, colour or product, the customer must return the original garment and place a new order.

16. Incorrect, damaged or defective products

If the customer receives an incorrect, damaged or defective product, they must contact us at info@flodenbrand.com, stating the order number and providing photographs where necessary to assess the issue.

When the issue is attributable to FLÖDEN, FLODEN COMPANY, S.L. will bear all costs required for the collection, replacement, repair or refund of the product, as legally applicable.

These cases will not be treated as voluntary returns, and the customer will not be charged any costs associated with resolving the issue.

17. Statutory guarantee of conformity

The products are covered by the statutory guarantee of conformity established under consumer protection law.

In Spain, the general liability period for a lack of conformity affecting new products is three years from delivery. Customers residing in other countries will retain, in all cases, the mandatory rights granted to them under applicable law.

If a product does not conform to the contract, the customer may request the remedies provided by law, such as repair or replacement and, where applicable, a price reduction or termination of the contract.

The guarantee does not cover normal wear and tear, damage resulting from improper use, accidents, alterations made by the customer or failure to follow the care instructions.

18. Liability

FLÖDEN will be responsible for fulfilling its obligations in accordance with these terms and applicable law.

FLÖDEN will not be liable for failures caused by unforeseeable circumstances or events beyond its reasonable control, without prejudice to the customer’s mandatory consumer rights.

Nothing in these terms limits or excludes any rights or liabilities that cannot legally be limited or excluded.

19. Customer service, complaints and claims

For any questions, complaints or claims, the customer may contact us at:

info@flodenbrand.com

If the enquiry concerns an order, the customer should include the order number so that we can locate it more easily.

The parties will attempt to resolve any dispute through direct communication. Where applicable, consumers may refer the matter to the relevant public consumer authorities or use any available mediation or alternative dispute resolution mechanisms.

20. Applicable law and jurisdiction

These terms are governed by Spanish law, without prejudice to any mandatory provisions of the law of the consumer’s country of residence that may apply.

Any dispute will be submitted to the courts and tribunals with jurisdiction under consumer protection law. Consumers will retain the right to bring proceedings before the courts of their place of residence where provided by law.

21. Amendments to these terms

FLÖDEN may update these terms to reflect legal changes or changes in the operation of the store.

The version applicable to each purchase will be the version published and accepted when the order was placed.
